Abstract

 

Parish of Sackville, Westmorland County, Yeoman. Will dated 18 January 1825, proved 1 September 1830. Wife Abigail use of the front room and bed room now occupied by us and situated at Northwest End of the dwelling House where I now reside, together with the Chamber in the Northwest End of Said House, one half the cellar under the house, one cow, the free use of a horse, and to be annually provided with ten bushels wheat, five bushels buckwheat, 56 pounds brown sugar, six pounds Souchong tea, 100 pounds beef, 200 pounds pork and £5 currency during her life. Sons Daniel WHATON and Benjamin WHATON each £200 to be paid to them £12 10s. yearly for ten years and £25 yearly thereafter. Daughters Mary FINNY, Charity KAY, Milleson EALS, Jemmima MAXWELL and Martha CORNWELL each £50 in ten yearly payments. Sons Thomas WHATON and David WHATON the residue of real and personal estate. Friends William FAWCETT, William FAWCETT Junr. and my son David WHATON executors. Witnesses: William CRANE, Charles F. ALLISON, Susan CRANE. On 22 January 1831 Martha WHATON, widow and administratrix of David WHATON, and Thomas WHATON gave a receipt to William FAWCETT and William FAWCETT Junr. as surviving executors of the estate for personal property received by Thomas WHATON and David WHATON to the value of £179 15s. 6d.

WILL

Thomas left property to his wife Abigail. Two sons, Thomas and David, appear to have been left with the land and house. This would appear to be consistent with the fact that both are buried in the nearby graveyard in Uppper Sackville. It appears that the other sons – Daniel and Benjamin – were off founding the WHEATON settlement, which is probably why they didn’t get left the land and house. (Note from JKW – Daniel and Benjamin were mentioned, see above and below for copies of Will)

 

This will showing Thomas WHEATON (who married Jane CHASE), as one of the two brothers inheriting the land and house is consistent with my family history that the land had stayed in my branch of the family down to my grandfather’s day (through 1980s)

Last Will of Thomas Wheaton

15 January 1825

 

In the name of God amen, I Thomas Wheton of Sackville, in the County of Westmoreland, Province of New Brunswick, Yeoman, being of sound and desposing mind and memory do make and devise this my Last Will and Testament in manner following, that is to say that I do hearby direct that all the just debts which I shall owe at the time of my death and also my funeral expences as soon after my demise as conveniently may be and as for the wordly estate which hath pleased God to bless me with, I give and dispose thereof as follows. I give and bequeth unto my beloved wife, Abigail, during the remainder of her natural life and in lieu of her dower, the use and occupation of the front room and bedroom now occupied by us and situated at the Northwest end of the dwelling house where I now reside, together with the chamber in the Northwest end of said house – also one half of the cellar under said house with free access to said rooms, chamber and cellar by the common passages – also one cow which she is at liberty to choose from such as may belong to my farm at the time of my demise – also the keeping of said cow on said farm or the keeping of any cow she may provide as long as she may require it. Also the free use of a horse for her to ride on, or use in any way she may wish at any time when she may call for the same. I also will and direct that there shall be delivered and furnished to her yearly ten bushels of wheat, five bushels of buckwheat, fifty-six pounds brown sugar, six pounds of tea, one hundred pounds fresh beef, two hundred pounds pork, ____ pounds of wool which said articles are all to be of good quality and the delivery of the same to commence in three months from the day of my demise and to be continued yearly during the term of her natural life as aforesaid. I also will and direct that there be paid to her seperately the sum of five pounds currency, the payment to commence on the day of the delivery of the articles as beforementioned and to continue during her life aforesaid – and it is my will and pleasure that the payments and delivery of the aforesaid bequests and legacies to my said wife is to be considered in lieu of and in full compensation of her right of dower in my estate and with the payment of which I charge my said Estate.

 

I give and bequeth unto my sons Daniel Wheton and Benjamin, their heirs and assigns, the sum of two hundred pounds currency each to be paid to them as follows – the yearly sum of twelve pounds ten shillings to each for the span of ten years – the first payment to commence in eighteen months after my demise and at the end and expiration of the said ten years they are to receive the sum of twenty-five pounds each yearly until it shall amount the whole of the said sum of two hundred pounds cash.

 

I give and bequeth to each of my daughters, Mary Finney, Charity Kay, Millison Eals, Jemima Maxwell and Martha Cornwall the sum of fifty pounds currency, the same to be paid to them in ten yearly payments, the first payment to commence in eighteen months after my demise and to continue until the whole sum of fifty pounds each as aforesaid is paid – and I do hearby will and direct that my real estate stand charged with the payment of the before mentioned legacies.

I give and bequeath to my sons Thomas Wheton and David Wheton, their heirs and assigns all the residue and remainder of my estate both real and personal wherever the same, may be situated or found to be held by them as tenants in common or otherwise as they may agree subject nevertheless to the payment of the several bequests and legacies given by me to my wife and other children before named – and I do hereby make, ordain, constitute and appoint my friends William Fawcett, William Fawcett Jr. and my son David Wheton, Executors of this my last Will and Testament hereby revoking all other and former Wills by me at any time heretofore and do declare this to be my last Will and Testament.

Details we have been sent suggest that Thomas’s father (born 1748) had two wives, Losy/Losey/Losa and Abigail

We were sent details for a son Thomas for both wives, theses Thomases were born 1789 and 1798 respectively

We were also sent Jane CHASE as the wife of both Thomases, idential marriage dates with practically the same children for both families.

 

From the 1851 census it is evident that the Thomas born 1798/1799 was married to Jane and as can be seen from the census information many of the children listed for both Thomas and Jane families were living with this Thomas who was born in 1798 and was the son of Thomas (b 1758) and Abgail.

A family tree on ancestry.com shows Thomas’s father James (b 1738) as the husband of Losee, was this Losy/Losey/Losa?

 

Did the person who sent a birth date of 20 November 1789 for the son of Thomas (b 1758) and Losy/Losey/Losa make a very easily transposed typing error with the year and it should be 1798?

 

Possible conclusion…

Thomas (born 1758) married once to Abigail FILLMORE and they are the parents of the Thomas born 1789 who married Jane CHASE.

Long ago I was sent the following information:

Her father, James WHEATON *UEL), a brother Thomas WHEATON (with wife, Abigail FILLIMORE and 2 children) and another brother, David WHEATON (single) also came to New Brunswick from New York”

“Angus McFEE and his wife Deborah (WHEATON) were also on the ship THETIS when it arrived at Fort Cumberland”.

 

Later, Hester’s son, Jeremiah SEARS married Deborah McFEE’s daughter Mary.

 

It has now been suggested that Deborah was a daughter of James. I have attached her to this family but I am not totally convinced at present because why was the fact that she was daughter of James and sister to Hester, Thomas and David not made clear in the information I had been sent previously?

 

Any information to clarify this would be very welcome.

 

Adam WHEATON writes 2/6/2013 “I still don’t believe that there is enough evidence to conclude she is the daughter of James Wheaton, though there is not enough evidence to disprove this either.”

ADMINISTRATIVE HISTORY/BIOGRAPHICAL SKETCH:

Carriage makers, Daniel and Elisha WHEATON, the sons of Mary KENNEDY and David WHEATON (1765-1851), were born about 1825 and 1822 respectively, in the parish of Sackville, Westmorland County, New Brunswick. By the early 1850s, both Elisha and Daniel were working in the carriage-making trade at Upper Sackville, Daniel as a carriage maker and Elisha as a blacksmith. Elisha and his wife, Rebecca KINNEAR, had no fewer than 8 children: Lucetty, Calvin, Anne, Herbert, Frank (1855-1927), Sarah, Frederick, and Carrie. These records suggest that Frank WHEATON had joined his father in the business by the 1880s. Other members of the WHEATON family were probably employed by the firm.

 

In addition to the manufacture and repair of wagons, carriages and carts, WHEATON Brothers made woodwork for carriages, racks, flooring, coffins, and iron work. The business also sold other goods: clapboards, shingles, lumber, cloth, clothing, boots, shoes, oats, hay, maple sugar, and flour. Customers paid their accounts in cash, kind, or labour. The business was still functioning in 1904.

 

SCOPE AND CONTENT:

This fonds consists of the business records of WHEATON Brothers. It includes 2 day books (1855-1864, 1885-1891) and a single account ledger (1854-1864, 1893-1904). The day books provide such detailed information as names of customers, dates of transactions, goods and products sold, services rendered, amounts charged, and payments received. There is also information pertaining to the hiring of workers, particularly, their date of hiring, term of employment, and wage promised.

 

The account ledger contains individual customer accounts that provide detailed information on goods and services purchased, amounts charged, and payments received. Frequently, the customer’s place of residence is noted. The firm’s customers lived in Sackville, Shediac, Amherst, Shemague, Salisbury, Petitcodiac, Coverdale, Tignish, Jolicure, Dorchester, and elsewhere.

The fonds also contains Frank WHEATON’s accounting exercise book or work book, which provides information on 19th century accounting practices. He may have been a student in the commercial department of Sackville Academy in the 1870s.

 

Lastly, there are a few household accounts of Hedley HICKS with Sackville merchants dating to the 1930s, along with a very few household accounts of E. A. WHEATON dating to the same period.

I have had information about David WHEATON and Martha WRY sent to me by two people

The first received had him as son of David

The second has him the son of Daniel

 

For some time I kept this David as son of Daniel saying I would keep it like that until I received further information

I have now received further information which indicates that the David who married Martha WRY was the son of David, grandson of Thomas. This does solve the problem that David was known as David Jnr which suggests his father was also a David

“Two of the daughters in this family, Rebecca and Mary Ann, were born after the death of Martha WRY’s husband David. Adam WHEATON sends the information that “Rebecca Wheaton’s death record in 1924 clearly lists her mother as Martha WRY and her father as “not known”. The informant was her son Charles PHINNEY”. At present we have no information that would identify the father of the two girls”.

“Daniel was the “founder” of WHEATON settlement. He and his brother Benjamin came down the Petticodiac River from Sackville in search of new land and ended up just west of Salisbury along the North River, which flows into the Petticodiac. Benjamin returned to Sackville”.

 

Note from Bill WHEATON 6/4/2002 concerning letter received from Vaughan GELDART. He writes:

“In 1803 Daniel WHEATON and his brother Benjamin in their late teens with an Indian Guide left Sackville to look for a place to start a farm. The Pericodiac River empties into the Bay of Funday which has the highest tides in the world. Sackville is near the mouth of the river. The bay and the mouth of the ruver are the shape of a large funnel so at high tide it comes up past Salisbury. The WHEATON brother must have come up river in a birch bark canoe and stopped at the home of William WILSON, where Dan met Ann, his future bride. The brothers and guide then continued past where the village of Salisbury id now, and then a portage trail through the forest to the North River a branch of the main river, about 2 miles. They decided on a place on the north side of the river and must have built a cabin soon after because Daniel and Ann were married January 14, 1806. Their son James married Elizabeth BROWN in 1845 and they had a daughter Amanda.

The two wives conundrum!

Details we have been sent suggest that Thomas’s father (born 1748) had two wives, Losy/Losey/Losa and Abigail

We were sent details for a son Thomas for both wives, theses Thomases were born 1789 and 1798 respectively

We were also sent Jane CHASE as the wife of both Thomases, idential marriage dates with practically the same children for both families.

 

From the 1851 census it is evident that the Thomas born 1798/1799 was married to Jane and as can be seen from the census information many of the children listed for both Thomas and Jane families were living with this Thomas who was born in 1798 and was the son of Thomas (b 1758) and Abgail.

 

Queries

Details received from Kelly WHEATON of WHEATON Loyalists in Canada makes no mention of a second wife for Thomas (b 1758)

So, did Thomas (b 1758) marry twice?

A family tree on ancestry.com shows Thomas’s father James (b 1738) as the husband of Losee, was this Losy/Losey/Losa?

 

Did the person who sent a birth date of 20 November 1789 for the son of Thomas (b 1758) and Losy/Losey/Losa make a very easily transposed typing error with the year and it should be 1798?

 

Possible conclusion…

Thomas (born 1758) married once to Abigail FILLMORE and they are the parents of the Thomas born 1789 who married Jane CHASE.

 

Information for this family is being amened to reflect this conclusion, but if anyone can provide details, backed up by original sources, to show otherwise, I will be more than happy to make the necessary corrections so that the information on my web site is accurate.

We were sent details for a son Thomas for both wives, the Thomases were born 1789 and 1798 respectively

We were also sent Jane CHASE as the wife of both Thomases with practically the same children for both families.

 

From the 1861 census it is evident that the Thomas born 1798/1799 was married to Jane, and given the dates of Thomas’s other children, this Thomas must be the son of Abigail. The entries will be amended to show this as far as possible. Children not shown on census returns as belonging to this family will be left as children of the Thomas born 1789 for the time being until more research has been carried out

On Tuesday 27th ult., Mrs. Jane WHEATON, Upper Sackville (West. Co.) widow of Thomas WHEATON, while engaged in conversation with her grandson, was striken with paralysis from which she never rallied. Up to the time of her death she was conscious of all around her, but was speechless. On Sunday morn. she passed away quietly and on Tuesday was interred in the cemetery at Upper Sackville. Mrs. Wheaton was in her 90th year.

Mrs. A.E. KILLAM, whose death has been announced, was Millicent WHEATON third d/o late Thomas WHEATON of Upper Sackville and was born in Sackville (West. Co.) on April 17, 1834 and was consequently nearly 55 years old at the time of her death.. She was married to A.E. KILLAM on Aug. 25, 1857 and had seven children by him, six of whom survive. The surviving children are Carrie KILLAM, Mrs. T.E. HENDERSON and Miss Jessie KILLAM, daughters, and Clarence KILLAM, Earnest KILLAM and Frank KILLAM, sons. The mother of the late Mrs. Killam still survives here and is now 87 years of age and two sisters and four brothers also mourn her loss. They are Losa WHEATON and Reuben WHEATON, Sackville; Thos. ADMINISTRATIVE HISTORY/BIOGRAPHICAL SKETCH:

Carriage makers, Daniel and Elisha WHEATON, the sons of Mary KENNEDY and David WHEATON (1765-1851), were born about 1825 and 1822 respectively, in the parish of Sackville, Westmorland County, New Brunswick. By the early 1850s, both Elisha and Daniel were working in the carriage-making trade at Upper Sackville, Daniel as a carriage maker and Elisha as a blacksmith. Elisha and his wife, Rebecca KINNEAR, had no fewer than 8 children: Lucetty, Calvin, Anne, Herbert, Frank (1855-1927), Sarah, Frederick, and Carrie. These records suggest that Frank WHEATON had joined his father in the business by the 1880s. Other members of the WHEATON family were probably employed by the firm.

 

In addition to the manufacture and repair of wagons, carriages and carts, WHEATON Brothers made woodwork for carriages, racks, flooring, coffins, and iron work. The business also sold other goods: clapboards, shingles, lumber, cloth, clothing, boots, shoes, oats, hay, maple sugar, and flour. Customers paid their accounts in cash, kind, or labour. The business was still functioning in 1904.

 

SCOPE AND CONTENT:

This fonds consists of the business records of WHEATON Brothers. It includes 2 day books (1855-1864, 1885-1891) and a single account ledger (1854-1864, 1893-1904). The day books provide such detailed information as names of customers, dates of transactions, goods and products sold, services rendered, amounts charged, and payments received. There is also information pertaining to the hiring of workers, particularly, their date of hiring, term of employment, and wage promised.

 

The account ledger contains individual customer accounts that provide detailed information on goods and services purchased, amounts charged, and payments received. Frequently, the customer’s place of residence is noted. The firm’s customers lived in Sackville, Shediac, Amherst, Shemague, Salisbury, Petitcodiac, Coverdale, Tignish, Jolicure, Dorchester, and elsewhere.

The fonds also contains Frank WHEATON’s accounting exercise book or work book, which provides information on 19th century accounting practices. He may have been a student in the commercial department of Sackville Academy in the 1870s.

 

Lastly, there are a few household accounts of Hedley HICKS with Sackville merchants dating to the 1930s, along with a very few household accounts of E. A. WHEATON dating to the same period.

The fonds also contains Frank WHEATON’s accounting exercise book or work book, which provides information on 19th century accounting practices. He may have been a student in the commercial department of Sackville Academy in the 1870s.

 

Lastly, there are a few household accounts of Hedley HICKS with Sackville merchants dating to the 1930s, along with a very few household accounts of E. A. WHEATON dating to the same period.

Died at Wheaton Settlement, 11th inst., Elizabeth WHEATON widow of Thomas WHEATON and grand daughter of John LUTZ, deceased, one of the old settlers of the vicinity of Moncton, 83rd year, leaving nine children, 73 grandchildren and great grandchildren. Mrs. Wheaton was born in the vicinity of Moncton Sept. 23, 1807 and on Nov. 15th, 1831 she was married to Thomas WHEATON. Shortly after Mr. and Mrs. Wheaton removed to North River settling in a log cabin in the woods where no we find a thriving settlement bearing his name. Some years later she experienced religion and about 35 years ago was baptized and united to the North River Free Baptist Church by Rev. G.A. Hartley. Both the parents of that family are now dead, but the children are all living, the eldest son being John A. WHEATON, railway contractor and builder. Funeral services were conducted 14th inst. by Rev. A.C. Thompson of Petitcodiac, assisted by Albin Perry, pastor of the church.

Scott ??? [MB: I can’t make out the surname of the minister].”

 

Then, the weird part, which could have been a mistake by the

“This marriage was solemnized between us, Robert HARRISON, Mary BENNETT in the presence of Robert BELL & Robert DUNCAN.”

 

Robert HARRISON? Where did that come from? I didn’t notice until I got back from the library, perhaps William is to be found in some other marriage record? Or maybe Robert HARRISON was the next person that the registar was going to be entering into the register so he/she accidentally put his name into Mary BENNETT’s marriage record?

 

The only Robert HARRISON I can find in the 1851 New Brunswick census is married to a “Delilah.”

Mrs. A.E. KILLAM, whose death has been announced, was Millicent WHEATON third d/o late Thomas WHEATON of Upper Sackville and was born in Sackville (West. Co.) on April 17, 1834 and was consequently nearly 55 years old at the time of her death.. She was married to A.E. KILLAM on Aug. 25, 1857 and had seven children by him, six of whom survive. The surviving children are Carrie KILLAM, Mrs. T.E. HENDERSON and Miss Jessie KILLAM, daughters, and Clarence KILLAM, Earnest KILLAM and Frank KILLAM, sons. The mother of the late Mrs. Killam still survives here and is now 87 years of age and two sisters and four brothers also mourn her loss. They are Losa WHEATON and Reuben WHEATON, Sackville; Thos.
