In 1810 US Census records John R WHEATON was living in New York City. The household consisted of one free white male, aged 16-44 one free white female aged 26-44, one female 10-15, one female under 10. In 1820 the same family (apparently) was living in Ward ( of New York City. The ages then were Male – 45 and over, Females – 45 and over, 26-45 and 16-26, i.e., roughly consistent with what we know of the birthdates (and adjusted for feminine vanity). In the 1820 census the WHEATON famly entry was immediately following that of George W MURRAY, almost certainly the brother of Elizabeth Murray WHEATON.

Another interesting item that I have come across is an entry in the Index to Suit Records, 1804-1813, for the Territory of Orleans (i.e. New Orleans) Superior Court. This shows that George W MURRAY and John R WHEATON were defendants in a lawsuit in that court, but the exact year is not given in the index.

Earlier this week I received from the New Orleans Public Library a CD containing images of documents relating to a lawsuit in which John R Wheaton, along with his brother-in-law George W Murray were defendants. The suit was entered in the Superior Court of the Territory of

Orleans in about 1811. So far I have only gone through the documents once, so merely have a superficial understanding of what happened. The combination of the old handwriting, the age of the original documents and the legalese make it difficult to decipher, but I will make further effort to do so.

However, what I currently believe to be the facts are: In 1810 the ship Mexican, alleged to be jointly owned by the firm of Murray & Wheaton and the firm of Winters, Harman, et. al., was due to sail from Hull to New Orleans. It apparently ran into difficulties – loss of the anchor and chain is mentioned – and thus incurred expenses for repairs and additional crew wages, etc. The plaintiffs sued Murray & Wheaton for $9,950 and apparently the jury found for the plaintiffs. Murray & Wheaton then appealed but I have not yet been able to determine what happened on appeal. It appears that by the time of the suit that the firm of Murray & Wheaton had become insolvent. In one document John R Wheaton is described as the surviving partner, but I interpret this to mean surviving in a legal sense, in regard to the firm, and not in a mortal sense. According to my records, George W. Murray lived until 1851. Murray & Wheaton are described as merchants and as being from New York. I doubt that either John R Wheaton or George W Murray ever went to New Orleans – they were simply represented by attorneys. The basis for their appeal appears to be contention over whether they in fact were owners of the vessel at the time of the problem, but I have yet to work this out.

“This is quite possible as some of Elizabeth’s siblings were early settlers in North America and Canada. Which means that it is also possible that Eliz Ives and Sarah Mary Anne were the only children born to them. As Elizabeth Murray’s family were in Norwich, it is also possible for the children to have been born there. It is mentioned in the book about Anne Murray POWELL that quite a number of “visits” were made to England by various members of the family (especially when things got tough in the “colonies”)

The Reverend John Marshall GUION was born in Rye, Westchester County, New York. He was a graduate of Columbia College in 1826 and the General Theological Seminary in 1829. For a time he was associated with Dr CRIEHGTON as assistant minister of St. Mark’s Church in New York City (Also known as “St Mark’s in the Bowery”)/ Later he became rector of parishes in Saybrook, Meriden, and New Britain, Connecticut. In 1853 he accepted a call to become assistant minister of St Paul’s in Baltimore, Md., remaining there until the destruction of the church by fire the following year. While in Baltimore he officated upon various occasions for the Chaplain of the United States Senate. In the year 1855 he accepted a call to the rectorship of Trinity Chuch at Seneca Falls, New York remaining there up to the time of his death in 1878. His degree of S. T. D. was conferred by Columbia College in 1865. His wife Elizabeth was the daughter of John Robert WHEATON of New York City and the granddaughter of Dr. John MURRAY of Norwich, England. She was born in Norwich, England January 5 1801 and died in Seneca Falls, New York on August 31, 1880.

John Marshall GUION, son of Dr John Marshall GUION, was born in Saybrook, Connecticut. His early life was passed in New Britain, Connecticut where he became a student in the State Normal School. In 1857 h removed with his parents to Seneca Falls, New York and was appointed Assistant Principal of the Seneca Falls Academy, a post he held until 1860 when he entered the law firm of General Josiah T MILLER. Upon the breaking out of the Civil War, he enlisted in the 33rd New York Infantry. He was Q.M,Sgt May 22bd 1861; 2nd Lieut January 24 1862; 1 Lieut, New York Veteran Calvalry,which company he helped o organize; Captain July 4th 1864 and Major December 31st 1864. He remained in the service until the close of the War. After the was he was prominent in Grand Army circles, and was a member of Cross Post of Seneca Falls, New York. He died in Seneca Falls, New York.

His wife,Susan Imogene was the only daughter of Edward S, and Susan Foster LATHAM, also of Seneca Falls, New York. They were married in Geneva, New York by the Rev. Dr. BISSELL, Bishop of Vermont. Susan Imogene LATHAM had her ancestry traced back to Charlemagne, King of France 742-813. She died March 18 1916 in her 74th year.

George William Murray GUION, the son of Dr. John Marshall GUION, was born in Meriden, Connecticut. In 1840 he moved with his parents to New Britain, Connecticut where they lived until 1854. Three years were passed in new Haven and New York, and in 1857 with the other members of his family, he settled in Seneca Falls, New York. There he became active in business. At the outbreak of the Civil War he organized a company of volunteers and he was commissioned its Captain on May 9 1861. His command became part of the 33rd New York Infantry. With that regiment in the Sixth Corps, Army of the Potomac, he was actively engaged in the Virginia and Maryland campaigns. After the Battle of Antiethum in September 1862, he was promoted to Lieutenant-Colonel of the 148th New York Infantry and assigned with his regiment to the 18th Corps n the Army of the James. He was commissioned Colonel of the 148th in October 1863 and with it participated in many severe engagements of the Richmond and Petersburg campaigns. He was assigned to the command of the 2nd Brigade. 2nd Division, 18th Army Corps, n August 1, 1864, was appointed Brigade-General in the New York Guard at the close of the War. He was a member of the Grand Army of the Republi and a Companion of the Militry Order of the Loyal Legion of the United States. He moved to Chicago in 1891.

Charles Frederick GUION, son of the Rev. John Marshall GUION D.D., was born in Meriden, Connecticut, He lived in New Britain until 1858, and after spending two years in Oswego, New York, became resident of Seneca Falls, New York in 1860, and was for some time in business there. In 1866 he moved to Auburn, New York and became engaged as a member of the firm C G MILK & Co., of that city. In 1884, after serving as Alderman, he was elected City Recorder which office he retained until 1894.
